The processing time for Italian citizenship applications based on residency and marriage is 24 months. The competent authorities must therefore process the applications WITHIN THIS TIME FRAME. They can extend the period from 24 to 36 months.
But to do so, the Prefecture should follow the legal requirements outlined in Article 9- ter of Law n. 91/1192, as amended by Article 4, paragraph 5, of the Decree-Law of October 21, 2020, which was then converted into Law n. 173 of December 18, 2020.
Before the expiry of the initial 24-month period, the authorities must send a notice informing the applicant, quoting the reference number K10/C/XXXXX, that the deadline for completing the administrative procedure for granting Italian nationality has been extended by a further 12 months. Receipt of this extension notice means that the competent authorities will have more time to complete the necessary steps and make a decision.
At present, the authorities do not have to give a specific reason for extending the deadline, but they MUST SEND AN EXTENSION NOTICE.
