About the renewal of the Italian residence permit
A recent court order (5 June 2023, n. 379 Consiglio di Giustizia Amministrativa per la Regione Siciliana) ruled that the failure to produce income statements by the foreigner does not prevent the renewal of the residence permit, as the applicant’s work potential and various circumstances contributing to the foreigner’s capability to support himself financially must also be taken into consideration.
In fact, according to the case law, for the purpose of renewing the residence permit, the assessment on the requirement of a minimum income should not only consider past incomes but must also be based on the possible job opportunities that may have arisen since the rejection and the potential integration of the foreign worker into the local context.
