The Administrative Court of Lazio (n.1221/2019, see also n. 8692/2018), confirmed that individuals applying for Italian citizenship iure sanguinis are claiming a “subjective right” and not a “legitimate interest”. Accordingly, in case of delays in the procedure of adjudication by the Public Office (both the Town Hall and the Consulate), the applicant can request the adjudication of citizenship to be granted directly by the competent Civil Court (Tribunale Civile), without the need to obtain a preliminary decision by an Administrative Court (Tribunale Amministrativo or TAR) to ackowledge the default by the Public Offices of granting the right to citizenship in a reasonable timeframe.
