Case 1948 Accepted
February 22, 2024 – Our Citizenship Team is pleased to announce the successful outcome of a claim filed on behalf of a Panamanian family. The judgement, issued on February 16, 2024 by the Ordinary Court of Turin, confirms the Panamanian family’s right to be recognised as Italian citizens by descent, through maternal line (before 1948).
In Decision No. 30 of 1983, the Constitutional Court declared the illegitimacy of Article 1, No. 1, of the 1912 law, which did not provide Italian citizenship for children of Italian national mothers. As a result, the court also recognized the right to recognition of Italian citizenship for the child of an Italian citizen mother born before January 1, 1948. This right is then transmitted to her children iure sanguinis.
The Judge made it clear that the Panamanian applicants have the right to be recognized as Italian citizens from birth, by virtue of their lineage from an Italian citizen, as established by Article 1 a) of Law No. 91/92, through the maternal line. This decision is a significant step toward overcoming discriminatory regulations and recognizing citizenship rights for those who have faced inequitable obstacles.
In conclusion, the successful outcome of the 1948 case by our Citizenship Team at the Ordinary Court of Turin indicates a step toward ensuring the rightful recognition of Italian citizenship… in this case for the Panamanian family through maternal descent.
